Court returns land of the "Buz'kyy Hard" park in Mykolaiv region to the state
The господар court of Mykolaiv Oblast returned almost 34 hectares of land belonging to the National Natural Park "Buz'kyy Hard" to state ownership. The land had previously been illegally registered as municipal property of the Oleksandrivka settlement council. Representatives of the settlement council acknowledged the claims, stating that they were unaware of the land's belonging to the natural reserve.
The prosecutor's office of Mykolaiv Oblast has secured the return of nearly 34 hectares of land belonging to the National Natural Park "Buz'kyy Hard" to state ownership. The regional court overturned the illegal registration of communal property belonging to the Alexandrivka settlement council on this plot of land.
Representatives of the Oleksandrivka village council fully acknowledged the plaintiff's claims, stating that they had no information about the property belonging to the natural reserve.
It has been established that in 2018, the State Environmental Cadastre transferred a number of plots to the municipal ownership of the Alexandrivka settlement council, one of which, after being divided in 2021, had an area of 39,6 hectares. According to experts' conclusions, 33,9 hectares of this land actually overlapped with protected areas of the "Buzhsky Yard" national park, which has national significance. This was confirmed by a letter from the park, a letter from the Ministry of Ecology, and a topographic survey conducted during the investigation by a certified land surveyor.
Law enforcement officials determined that the transfer of land to municipal ownership occurred without the required approval from the relevant ministry and without a change in its intended purpose. The National Natural Park "Buz'kyy Hard" was established in 2009 to preserve unique natural and historical-cultural complexes in the valley of the Southern Buh River. The land of the park belongs to objects of the national natural reserve fund of Ukraine and is under special state protection. The NP "Buz'kyy Hard" is one of the winners of the all-Ukrainian campaign "7 natural wonders of Ukraine".
