Owners of the Odesa restaurant "Dacha" lost a court case regarding passage.

Owners of the Odesa restaurant "Dacha" lost a court case regarding passage.

The Economic Court of the Odesa region ruled that the restriction on traffic to the "Dacha" restaurant through the territory of the memorial park is lawful. The court determined that ownership of the building does not grant the right to unimpeded access without proper documentation of land use. The owners of the restaurant demanded to ensure free access for employees and transport.

The Economic Court of Odesa Oblast, on October 22, issued a ruling in favor of the "Forest Glade" veterans rehabilitation center in a case concerning the unrestricted access of vehicles to the "Dacha" restaurant through the territory of the memorial park.

The court ruled that the actions of the rehabilitation center regarding the preservation of the protected status were lawful, stating that ownership of the building does not automatically grant the right to unimpeded passage through the park's territory without proper documentation of land use rights.

"Drive-In LLC, which owns the building of the "Dacha" restaurant located in the "French Park" area, has demanded that the State Institution "Center for Mental Health and Rehabilitation of Veterans "Forest Glade" of the Ministry of Health of Ukraine remove obstacles to the use of the property and ensure free access and passage for the company's employees and transport from Sanatornyy Proyulok.

Representatives of the restaurant claimed that the restrictions on entry, introduced at the beginning of 2025, violate their rights as property owners and hinder the operation of the establishment. In contrast, the Veteran Rehabilitation Center, which has been using the land plot, along with the Ministry of Health and the Odesa Oblast Administration, emphasized the special security regime for the protected natural area. According to representatives of the rehabilitation center, vehicle access is limited in accordance with the law, while pedestrian access for restaurant guests remains open, and service vehicles are allowed with prior agreement.
