Odesa: Court resumes case regarding 8,4 million UAH share participation from a developer on Velika Arnaustska Street

The Economic Court of Odesa Oblast resumed the prosecution's lawsuit against PJSC "Southern Financial and Construction Company" for 8,4 million UAH in favor of Odesa. More than 7,3 million UAH of this amount are equity contributions that the company, according to the prosecution, unjustly retained. The dispute concerns apartments with a parking space on Velika Arnautska Street, 115; the company's funds have been seized as part of the lawsuit.

The Economic Court of the Odesa region resumed proceedings in a case initiated by the Odesa City Council against "Southern Financial and Construction Company" on behalf of the Odesa District Prosecutor's Office. The prosecutor's office is seeking to recover 8 million 434 thousand 798 hryvnias in favor of the city.

Out of this amount, over 7,3 million UAH is from the share contribution, which, according to the prosecutor's office, the company has unreasonably retained, 830,3 thousand UAH is calculated as inflation losses, and 282,8 thousand UAH is calculated as three percent per annum.

The dispute concerns the construction of apartments with built-in administrative and commercial spaces and an underground parking lot on Velika Arnautska Street, 115. Previously, the court ordered a construction and technical expertise to determine the actual cost of construction and compare it with the data in the documentation for putting the object into operation and the design and estimate documentation, specifically to verify whether the costs for the land plot, site preparation, engineering networks, and transport infrastructure were taken into account. The cost of the expertise was 45 thousand UAH, and the payment was placed on the construction company. Following the expert's assessment, which had been temporarily suspended during the investigation, the proceedings have been resumed.

Separately, in the case, the prosecution requested that the company's funds be seized up to the amount of the claim. The first-instance court initially refused, but the appellate economic court overturned this decision and ordered the seizure of funds from the company's accounts up to 8,43 million UAH. The parties were asked to provide explanations regarding the expert's conclusion, after which the court will proceed to consider the claims for the recovery of funds in favor of the city.
